Terms and Conditions for Pork Farms’ Pop Up Parties campaign 2017
- INTRODUCTION TO TERMS
1.1 This website and microsite is owned and operated by Pork Farms Ltd, part of the Addo Food Group.
1.2 These Terms govern the use of the Sites, including participation in the Pork Farms Pop Up Parties competition and social media use.
1.3 If you do not agree with these Terms, you should not enter the Pork Farms Pop Up Parties competition.
1.4 Pork Farms may modify these Terms from time to time. Use of the Site by you and entering the Pork Farms Pop Up Parties competition will constitute your acceptance of any changes or revisions to the Terms.
- USE OF THE WEBSITE BY YOU
2.1 Pork Farms owns all material on the Sites. You may not in any way make commercial or other unauthorised use, by publication, re-transmission, distribution, performance, caching or otherwise, of material obtained through the Sites.
2.2 You are responsible for ensuring that any material, details, video or imagery you provide to the Sites by entering the Pork Farms Pop Up Parties competition does not violate the copyright, trade mark, trade secret or any other personal or proprietary rights of any third party.
2.3 You are responsible for ensuring that all personal contact details provided in the entry process are valid and correct.
2.4 All content, images and videos will be checked prior to being visible on the Sites. However, you acknowledge that human mistakes happen and should that be the case Pork Farms does not endorse inappropriate content.
3.1 By using the Sites and entering the Pork Farms Pop Up Parties competition you confirm that you are 18 years old or more or, if you are under 18 years old, that you have received your parent’s or guardian’s consent to enter into these Terms.
3.2 In order to participate in the Pork Farms Pop Up Parties campaign you must be a permanent resident in either England, Scotland or Wales.
- USE OF MATERIAL POSTED BY YOU
4.1 Posting entries to the competition on the website are not private, however your personal details will be. You grant Pork Farms a perpetual royalty free non-exclusive license to use, reproduce, modify, translate, transmit, distribute and sub-licence any information or material you supply or communicate to the websites via such postings, in any medium now in existence or hereafter developed, for any purpose, including commercial uses to any third party. Pork Farms will not return it if submitted, and accepts no liability whatsoever for safe custody thereof.
4.2 By entering the Pork Farms Pop Up Parties competition and sharing any contribution(s) with us (including but not limited to data, text, photo, message, posting, image, logo, attachment, hyperlink and all other content (collectively known as Contributions) to the website, you agree and grant Pork Farms free of charge permission, to use the Contribution(s) at sole discretion (including modifying and adapting it for PR purposes and editorial reasons) in connection with the Pork Farms Pop Up Parties competition. The license extends to copying, distributing, broadcasting or otherwise transmitting, adapting or editing the Contribution(s).
4.3 By entering the competition, your details will be added to a Pork Farms database for future marketing purposes unless you specifically opt out and these can be shared by third parties deemed appropriate by Pork Farms.
- THE PORK FARMS POP UP PARTIES COMPETITON AND PRIZES
5.1 The Pork Farms Pop Up Parties competition is giving five winners the chance to have a free party. The prize is as stated, non-transferable or redeemable for cash equivalent.
5.2 The Pork Farms Pop Up Parties competition opens for nominations on July 3rd 2017 and ends August 28th 2017 at midnight. Entries received after this closing date will not be accepted, counted or considered for the competition.
5.3 Nominees must be available week commencing October 23rd before being submitted by their nominators.
5.4 Pop Up Parties winners’ week runs October 23rd -27th 2017.
5.5 Online nomination forms must be filled out in full with all mandatory fields complete to be entered for the competition. Entries in the incorrect format or without the detail required will not be considered.
5.6 Once entered, entries cannot be returned, however you can opt out should you wish.
5.7 No purchase is necessary to enter the Competition.
5.9 When dates are specified they cannot be altered and by entering date-related Competitions Pork Farms are not liable in any way to any winner who cannot attend.
5.10 The Pork Farms Pop Up Parties competition is not open to any employees of the Addo Food Group, KRPR, Fat Media or Veracity Marketing or their immediate families.
5.11 Unless otherwise stated only one Competition entry, fulfilling the eligibility requirements above, will be accepted per person.
5.12 Entrants will be deemed to have accepted these Terms and to have agreed to be bound by them.
5.13 Pork Farms decision is final in every situation, including any not covered above and no correspondence will be entered into in respect of the validity of any such decision.
5.14 Pork Farms shall be permitted to exclude or disqualify any entrant at any time at its sole discretion.
5.15 Pork Farms reserves the right to exclude late, incomplete or multiple registrations.
5.16 Pork Farms does not accept any responsibility for late or lost entries.
5.17 Entry to the Competition and acceptance of the prize constitutes permission to use any entrant’s name, image and any competition entry photograph, for promotional and/or editorial purposes in any format in print and non-print media without additional consultation.
5.18 By taking part in the competition, Pork Farms reserve the right to publish entries, including parts of entries, and names, although a published entry does not necessarily mean the entry has won the competition, won a prize or come as a runner up in the competition.
5.19 Entry to the Competition and acceptance of the prize constitutes permission to use the entrant / winner nominated in print publications, on social media channels and broadcast publicity opportunities with TV and Radio. Failure to agree to this will disqualify the winner.
5.20 The prize must be taken as stated and cannot be deferred although Pork Farms reserves the right to change the prize in the event of unforeseen circumstances. There will be no cash alternative.
5.21 Pork Farms reserves the right to (i) cancel and/or withdraw this Competition and/or (ii) amend these Terms, at any time without notice.
5.22 To the fullest extent permitted by applicable law, in no event will Pork Farms Ltd or Addo Food Group be liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss, damage or injury arising under or in connection with this Competition.
5.23 To the fullest extent permitted by applicable law, in no event will KRPR (trading name of KR Public Relations Limited), Fat Media, Veracity Marketing or any third party contracted be liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss, damage or injury arising under or in connection with this Competition.
5.24 Where Pork Farms runs a competition with a promoter such that the promoter is responsible for the selection and/or the provision of prizes then Pork Farms and KRPR, Fat Media, Veracity Marketing shall not be responsible for or have any liability for the provision of such prizes.
5.25 These Terms are governed by English law, and entrants agree to submit to the exclusive jurisdiction of the English Courts in relation to all matters arising under or in connection with these Terms.
5.26 Voting to find the top 25 nominations opens on August 31st 2017 and ends September 22nd 2017 at midnight.
5.27 The voting mechanism will run across Pork Farms’ website – only one vote can be placed by each registered voter.
5.28 If the nomination reaches the top 25 finalists, Pork Farms will contact the nominator to discuss location and timings of your nominee’s party in preparation of a potential winner announcement.
5.29 The top 25 finalists will be assessed by our chosen panel of independent judges to decide on the final five winners. They will not be marked against any set criteria or be ranked based on the voting phase, but be chosen by our judges who deem the community group, project or person as the most deserving of the prize.
5.30 The winning entries will be revealed after the voting comes to a close and the winning entrant (“the nominator”) shall be notified by telephone by 25th September 2017. Nominators will need to re-confirm location and time slot details – Pork Farms and the nominator will work together to keep the nominee’s Pop Up Party a surprise up until the agreed party date.
5.31 If the winning nominator fails to respond to notification of their win within 48 hours or fails to meet any of the eligibility requirements, this may result in forfeiture of the prize and we reserve the right to disqualify the winner (without further liability to the winner) and offer the prize to the next eligible entrant.
5.32 Winners and attendees must be available on a time and day stated by Pork Farms during the week of October 23rd – 27th 2017. It is the nominators responsibility to invite a maximum of 50 guests to the party.
5.33 Each party is to be held at a mutually agreed location between Pork Farms and the winning nominator. Permission will need to be granted for use of venue i.e. place of work/school etc.
5.34 Pork Farms accepts no liability for any allergies or reactions to food provided. Basic food allergy alternatives will be provided and marked within the catering if required and stated in advance.
5.35 The party will be for a maximum of 50 people and offer a selection of buffet food, a selection of soft drinks, alcoholic beverages for over 18’s attending, award for the winner, party games, tables, chairs, all crockery, cutlery, glasses, decorations, party poppers, and entertainment. Catering will reflect the number of attendees only. Number of attendees to be agreed in advance of the party.
5.36 Each party will continue for a maximum of two hours. Exact times to be confirmed between nominator and Pork Farms in advance.
5.37 Pork Farms will be responsible for the set-up, production and breakdown of the party. Nominators will be responsible for arranging the logistics of waste disposal and any necessary access needed at the venue in advance.
5.38 Pork Farms accept no liability for any incident or injury incurred by any attendee present at the party.
5.39 Travel to and from the location of the Pop Up Party is not included.
